Section 175-95 MAINTENANCE, PUBLIC SAFETY AND PERMITTED USES.
A.
Nothing
in this Article shall allow the BAR to prevent the
routine maintenance or repair of any exterior elements of any
building or
structure so long as there is no change in form or materials; nor shall
anything in this Article be construed to prevent the construction,
reconstruction, alteration or demolition of any exterior elements that
the
authorized municipal officers shall certify as required by public
safety.
B.
Nothing
in this Article shall be construed to prevent any use
of any land, building or structure permitted by the regulations
prescribed in
this Chapter for the district in which such land, building or structure
is
otherwise located. Due to peculiar conditions of design and
construction in
historic neighborhoods where buildings and structures are often
built
close to the lot lines, it is in the public interest to retain a
neighborhood's
historic appearance by granting variances to normal yard requirements,
where
appropriate and where it is deemed that such a variance will not
adversely
affect neighboring properties. The BAR may recommend to the Board
of
Zoning Appeals that such variance to standard yard requirements be made.
