Section 175-41        MAXIMUM HEIGHT OF BUILDINGS.


A. Residential Buildings: 35 feet, except as otherwise provided in this section.

 

B. Other Principal Buildings: 45 feet except as provided in Section 175-39B.

 

C. Residential structures may have a maximum overall height of 45  feet, provided that the slope of the roof exceeds 35 percent and the required yards are increased by one (1) foot for    each foot in height over 35 feet.

 

D. Exemptions from height requirements:

 

     1. Church spires.

 

     2. Belfries.

 

     3. Cupolas.

 

     4. Municipal water towers.

 

     5. Chimneys.

 

     6. Flues.

 

     7. Flagpoles.

 

     8. Television antennas.

 

     9. Radio aerials.

 

   10. Parapet walls up to four (4) feet above the height of the building on which the wall rests.

 

E.  Accessory buildings and structures: 35 feet; however, in no case, shall the height of an accessory structure exceed the height of the principal structure.

 

F.  Where the Town approves a structure exceeding 45 feet in height, the maximum height shall be seventy (70) feet and up to six (6) stories.  All required yards shall be increased by two (2) feet for each foot over forty-five (45) feet.    There shall be a minimum lot size of seven thousand five hundred (7,500) square feet; however, in the case of permitted  renovation of a residential use, the lot must be six thousand (6,000) square feet, plus an additional one thousand five  hundred (1,500) square feet for each individual dwelling unit  above one (1).
