Chapter 148 SUBDIVISION AND LAND DEVELOPMENT. (updated 7-28-08)
Section 148-41 SIDEWALKS.
A. For
all subdivisions involving the creation of an
additional buildable lot or lots, sidewalks shall be required on both
sides of
all public streets within the subdivision and on the side of each
street
touching the subdivision, unless other provisions have been made and
approved
by the town for an alternative system of pedestrian walkways.
This
requirement for sidewalks along existing public streets may be waived
on vote
of the Town Council in residential areas where curb and gutter has been
waived
to Section 149-40(C), or where any newly created lots exceed one-half
acre in
size, or where the existing development pattern would likely rule out
the
orderly creation of a complete sidewalk network in the long term. Such
waiver
shall not include existing streets designated in the Town Plan as
important
sidewalk linkages. Public sidewalks shall be required for all
commercial
developments and multifamily residential developments. Public
sidewalks may
be required by the town for industrial lots.

B. All
sidewalks and walkways shall be a minimum of
four (4) feet in width. Where sidewalks abut a curbline with
adjoining ninety-degree-angle
parking, the sidewalks shall have a minimum width of five (5) feet.
C. Sidewalks
shall normally be parallel to the
street. Nonparallel sidewalks and/or walkways may be approved by
the town
in order to preserve topographical or natural features and to
provide
visual interest.
D. Where
pedestrian walkway systems have been
approved as an alternative to sidewalks, the walkways may be
located away
from streets, linking groups of dwelling units with other groups of
dwelling
units and/or facilities such as parking areas, recreational areas and
activity
centers. In reviewing the location of alternative walkway
systems, the
town shall consider safety, practical accessibility and aesthetics.
E. Public
easements
shall be granted for sidewalks and/or walkways located outside the
public right-of-way.
F. All
sidewalks
shall be constructed in accordance with town standards and
specifications
and shall conform to the requirements of Section 15.2-2021, Code of
Virginia,
as amended, requiring curb ramps for the handicapped. Curb ramps shall
comply
with the Virginia Department of Transportation’s Road and Bridge
Standards.
