Chapter 148 SUBDIVISION AND LAND DEVELOPMENT. (updated 7-28-08)
Section 148-35 FLOODPLAIN REGULATIONS.
A. Land
within a one-hundred-year floodplain may be
platted, provided that such lands are not used to meet the minimum
required lot
size and are designated on the plats as a floodplain easement area and
that the
subdivision would not necessitate changes to topographic conditions
that alter
the floodway district.
B. Any
development shall be restricted to such uses
as are permitted under the town's Floodplain Zoning Ordinance, Town
Code
Section 175-74 et seq.
C. Except
where floodplain development is permitted,
floodplain areas shall be maintained in their natural state.
