Chapter 148 SUBDIVISION AND LAND DEVELOPMENT. (updated 7-28-08)

Section 148-31 SOIL EVALUATION TEST REQUIREMENTS

A.  The results of State Health Department soil evaluation tests made in accordance with departmental regulations shall be submitted with the final plat for all subdivisions where on-site sewage disposal systems are to be employed.

B.  No plat shall be approved for a subdivision where septic tanks are to be employed, unless a tentative approval from the Health Department is received stating that all lots in the subdivision have a suitable site for a septic tank system.  If the soil evaluation test results reveal that the soil is unsuitable for the intended use at the lot size proposed, the town shall require that lot size be increased in accordance with the determination of the State Health Department.
