Section 134-6 VARIANCES AND AGREEMENTS
THE TOWN
shall have the right to enter into special agreements
with users setting forth terms under which the user may
discharge into
the
municipal wastewater system. In no case will a special
agreement
waive
compliance with a pretreatment standard. However, the
industrial
user may
request a net gross adjustment to a categorical standard in
accordance
with 40
CFR Part 403.15. Industrial users may also request a
fundamentally
different
factor variance from the Categorical Pretreatment Standards of
the
USEPA. Such
a request must be either approved or not objected to by the EPA
and
will be
permitted by the Town only if the user can prove that factors
relating
to its
discharge are fundamentally different from the factors
considered by
the USEPA
when establishing its pretreatment standard. An industrial user
requesting a
fundamentally different factor variance must comply with
procedural and
substantive provisions set forth in 40 CFR Part 403.13.
